Hallo
Ist ein Kind von einem deutschen und einem amerikanischen Elternteil automatisch US Bürger?
Wenn ja kann es diese automatische Staatsbürgerschaft ablehnen?
Wenn ja wie?

Muss die doppelte Staatsbürgerschaft erst beantragt werden?
Was passiert wenn man das nicht macht?

Muss das Kind später auch eine amerikanische Steuererklärung abgeben auch wenn es keine Staatsbürgerschaft hat? Wie kann man das abschaffen? Man braucht ja eine iTin oder SSn um die Steuererklärung zu machen.

Ich finde dazu keinerlei Informationen.

Das Kind ist erst dann Doppelbürger, wenn bei den US-Behörden eine Geburtsanzeige eingeht.

Nein, es muessen bestimmte Voraussetzungen erfuellt sein. Diese stehen hier:

Are you the foreign-born child of a parent who becomes a U.S. citizen?

Children of U.S. Citizens Residing in the United States
Children who were born outside the U.S. but now live in the U.S. may acquire citizenship under Section 320 of the Immigration and Nationality Act (INA). A child born outside of the United States automatically becomes a U.S. citizen when all of the following conditions have been met on or after Feb. 27, 2001:
  • The child has at least one parent, including an adoptive parent, who is a U.S. citizen by birth or through naturalization;
  • The child is under 18 years of age;
  • The child is a lawful permanent resident (LPR); and
  • The child is residing in the United States in the legal and physical custody of the U.S. citizen parent.

Children of U.S. Citizens Residing Outside the United States
Children residing outside of the United States may obtain citizenship under Section 322 of the INA. A child who regularly resides outside of the United States is eligible for naturalization if all of the following conditions have been met:

  • The child has at least one parent, including an adoptive parent, who is a U.S. citizen by birth or through naturalization;
  • The child’s U.S. citizen parent or U.S. citizen grandparent meets certain physical presence requirements in the United States or an outlying possession;
  • The child is under 18 years of age;
  • The child is residing outside of the United States in the legal and physical custody of the U.S. citizen parent, or of a person who does not object to the application if the U.S. citizen parent is deceased; and
  • The child is lawfully admitted, physically present, and maintaining a lawful status in the United States at the time the application is approved and the time of naturalization.

Ja, man kann die US Staatsbuergerschaft ablehnen, aber das kostet eine Menge Geld. Eltern koennen dies nicht fuer ihre minderjaehrigen Kinder entscheiden.

F. RENUNCIATION FOR MINOR CHILDREN/INDIVIDUALS WITH DEVELOPMENTAL OR INTELLECTUAL DISABILITIES

Citizenship is a status that is personal to the U.S. citizen. Therefore parents may not renounce the citizenship of their minor children. Similarly, parents/legal guardians may not renounce the citizenship of individuals who lack sufficient capacity to do so. Minors seeking to renounce their U.S. citizenship must demonstrate to a consular officer that they are acting voluntarily, without undue influence from parent(s), and that they fully understand the implications/consequences attendant to the renunciation of U.S. citizenship. Children under 16 are presumed not to have the requisite maturity and knowing intent to relinquish citizenship; children under 18 are provided additional safeguards during the renunciation process, and their cases are afforded very careful consideration by post and the Department to assess their voluntariness and informed intent. Unless there are emergent circumstances, minors may wish to wait until age 18 to renounce citizenship.

Wenn man von Geburt an sowohl US Staatsbuerger als auch auslaendischer Staatsbuerger ist, dann muss man die doppelte nicht beantragen, glaube ich, da bin ich aber nicht sicher.

Muss das Kind später auch eine amerikanische Steuererklärung abgeben auch wenn es keine Staatsbürgerschaft hat? Wie kann man das abschaffen? Man braucht ja eine iTin oder SSn um die Steuererklärung zu machen.

Man muss immer eine US-Steuererklaerung machen, wenn man US Staatsbuerger ist, auch wenn man keinen Pass hat. Es gibt aber Einkommensgrenzen und in der Regel geht ja ein achtzehnjaehriger noch zur Schule oder macht eine Ausbildung, daher kann es sein, dass dann noch keine Steuererklaerung gemacht werden muss, da wuerde ich mich aber genau erkundigen.

Wenn man die Staatsbuergerschaft aufgibt, heisst das nicht automatisch, dass man sofort nicht mehr verpflichtet ist, eine Steuererklaerung zu machen.
Man muss form 8854 einreichen.

Anja, wenn man das Kind gar nicht erst den US-Behörden meldet, dann hat es auch keine US-Stabü, wie auch? Weiß ja keiner davon.
Denk doch nur an all jene, die gern zwei Pässe hätten, weil ein Elternteil US-Bürger ist und wie schwer es nachträglich ist, den US-Pass dann noch zu bekommen.

Eigentlich ist es ziemlich easy den US Pass zu bekommen, zumindest wenn man bei der Antragstellung noch unter 18 Jahre ist.

Hallo Gast 0815. Ich hatte die Situation gerade. Ich bin Deutsche mein Mann Ami und unser Sohn ist in Deutschland zur Welt gekommen. Wir leben alle hier in Deutschland. Ich bin zu 80% der Meinung, dass durch Geburt die US Amerikanische Staatsbürgerschaft schon vorhanden ist. Aber da kann ich auch falsch liegen. Habe mich gerade erst vor ein paar Monaten damit auseinandergesetzt und das irgendwo gelesen. Viele sind deswegen auch so verärgert, weil sie die Steuererklärung abgeben müssen, obwohl sie mit dem Land nichts zu tun haben und die US Staatsbürgerschaft aufzugeben kostet wohl viel Geld.

Also wir haben beim Konsulat in Frankfurt alles geregelt (guck mal auf der Website, da steht auch glaube ich etwas über die Aufgabe der US Staatsbürgerschaft). Der US Bürger muss nachweisen in den Staaten mind. 5 Jahre gelebt zu haben (2 Jahre oder so müssen glaube ich vor dem 14 Lebensjahr gewesen sein. Mein Mann hat immer da gelebt, also war das nicht so relevant). Wenn das nicht gegeben ist, hat das Kind erstmal kein Recht auf die Staatsbürgerschaft. Die 2. Möglichkeit ist, dass die US Großeltern des Kindes die Staatsbürgerschaft für das Enkelkind beantragen. Die können das aus dem USA machen und dann muss das Kind mit seinen Eltern zum Konsulat in Deutschland. Wir haben also die Geburt unseres Sohnes bekannt gegeben und kriegen jetzt eine Geburtsanzeige aus den USA, außerdem haben wir einen Passport beantragt. Wenn das alles vorliegen können wir die Social Security Number beantragen. Wir konnten übrigens bislang auch noch kein Konto für unseren Sohn in Deutschland einrichten, weil du ein Verhältniss zue USA abgeben musst und wir die SSN ja noch nicht haben.

Loss of U.S. citizenship is a serious and irrevocable act which deserves your thoughtful consideration. It is imperative that you fully understand the nature of its consequences prior to requesting a Certificate of Loss of Nationality. If you decide that this is the course of action you wish to pursue, there are several steps you need to take including arranging an appointment to come into the Embassy to sign the Statement of Understanding, the Loss of Citizenship Questionnaire and/or the Oath of Renunciation, in the presence of a Consular Officer. Please note that the Statement of Understanding clearly states that the action you are taking is irrevocable.

Remember that expatriation is a personal right and can never be exercised by another person (including parents and/or legal guardians).

Become familiar with the legal requirements and possible expatriating acts before beginning this process. Pay particular attention to your right to request an informal initial appointment to discuss your possible loss of citizenship with a consular official over the phone or in-person prior to your final interview. For questions related to expatriation tax and possible tax implications, please consult with the Internal Revenue Service.

You will be required to pay a non-refundable fee of $2,350 or equivalent in Euros.

All renunciations and other recognitions of loss of nationality for U.S. citizens in Germany are processed at the U.S. Consulate General in Frankfurt. Email renunciations@state.gov to arrange for an appointment, and for more information on the required documentation.
