6 Monate B1/B2

Hallo zusammen,

ich suche derzeit nach ein bisschen Hilfe bzgl eines B1/B2 Visums.

Folgende Situation: ich habe ein J1 Visum, da ich ab April bis August in die USA Praktikum machen gehe, und würde gerne meine Freundin (russische Staatsbürgerschaft) mitnehmen. Sie wird dort weder arbeiten noch studieren. Reicht dafür das B1/B2 visum aus? Bzw sollte sie, falls sie gefragt wird angeben das sie mit mir dorthin zieht oder kann ihr dann unter Umständen die Einreise verweigert werden?

ich wäre um jeden Rat dankbar, oder kennt jemand einen Anwalt der sich damit auskennt?

Sie sollte auf jeden Fall angeben, dass sie "Deinetwegen" das Visum beantragt; es gibt eine "Unterkategorie" im B2 für sogenannte "cohabitating partners". Genau das ist eine der Situationen, für die dieses Visum gedacht ist.

The B-2 classification is appropriate for aliens who are members of the household of another alien in long-term nonimmigrant status, but who are not eligible for derivative status under that alien's visa classification. This is also an appropriate classification for aliens who are members of the household of a U.S. citizen who normally lives and works overseas, but is returning to the United States for a temporary time period. Such aliens include, but are not limited to the following: cohabitating partners or elderly parents of temporary workers, students, diplomats posted to the United States, and accompanying parent(s) of minor F-1 child-student. B-2 classification may also be accorded to a spouse or child who qualifies for derivative status (other than derivative A or G status) but for whom it may be inconvenient or impossible to apply for the proper H-4, L-2, F-2, or other derivative visa, provided that the derivative individual intends to maintain a residence outside the United States and otherwise meets the B visa eligibility requirements. If such individuals plan to stay in the United States for more than six months, they should be advised to ask the Department of Homeland Security (DHS) for a one-year stay at the time they apply for admission. If needed, they may thereafter apply for extensions of stay, in increments of up to six months, for the duration of the principal alien's nonimmigrant status in the United States. You should consider annotating to indicate the purpose and length of stay in such cases.

Vielen vielen Dank für die schnelle Antwort!

okay, das ist ja schon einmal super! Ich habe vergessen zu erwähnen das sie bereits ein 3-Jahres B1/B2 Visum hat, allerdings mit dem Grund, eine Freundin zu besuchen. Dieses wurde letztes Jahr im April ausgestellt. Sie hat die Freundin im August dann auch besucht.

Ist natürlich "multiple entry"

Muss oder sollte sie nun ein neues B1/B2 visum beantragen? Mit dem neuen besuchsgrund? Der Typ des Visums bleibt ja gleich.

nicht das ich dir nicht traue, aber das Homelands Department hat nicht den besten ruf was Russinnen angeht ;)

Du hast ein gueltiges Visum. Du darfst einreisen. Punkt. Das ist der ganze Zweck eines Visums.

Der Grund, warum es irgendwann mal erteilt wurde, ist nach der Ausstellung des Visums irrelevant. Solange Du Dich an die Bedingungen des Visums haelst (z.B. nicht mit einem B1/B2 arbeiten gehen) hast Du kein Problem. Dazu jetzt einen Link oder ein Dokument zu erwarten, dass bestaetigt, was in den Vorschriften zur Erteilung eines Visums steht, erinnert dann doch Stark an das Lied von Reinhard Mey bzgl. des Antrags zur Erteilung eines Antragsformulars...

Don't overthink it.
