So viel ich weiss, spielt das keine Rolle, ich glaube, es geht darum, WIE man die GC erhalten hat.. sprich "durch Heirat".. aber ich kann mich da natuerlich taeuschen... war noch nicht in so einer Situation

Grins...ich wusste es schon, aber wollt halt hoeflich sein und hatte gestern auch nicht die Zeit, um Belege rauszusuchen, daher die weniger direkte Frageform

Heute hab ich mir nun die Muehe mal gemacht, und es ist tatsaechlich so, dass sie zum Zeitpunkt des Antrags noch mit dem US citizen verheiratet sein muss, um in den Genuss der 3-Jahres Regelung zu kommen:

If you are at least 18 years old and:

Are currently married to and living with a U.S. citizen;

and

Have been married to and living with that same U.S.
citizen for the past 3 years;

and

Your spouse has been a U.S. citizen for the past 3 years.

Gibt noch eine Sonderregelng fuer "Soldatenwitwen":

If you are at least 18 years old and:

Were married to a U.S. citizen who died during a period of
honorable active duty service in the U.S. Armed Forces.

NOTE:

You must have been married to and living with

your U.S. citizen spouse at the time of his/her death

Aber das war's dann auch schon.

Also wuerde in diesem Fall die 5 Jahresfrist zutreffen.

Aber egal, wielange sie sie schon hat, die Anforderung fuer die naturalization waere 5 Jahre, da sie in Scheidung lebt...das meinte ich mit "zutreffen"
